ADA ENFORCEMENT

Hello to All,
How many of us out there have or are currently experiencing Discrimination or Problems due to a Physical or Mental Disibility (Deficit) or Both. Either because your Deficit is visible……………. Or Specifically since your Deficts are NOT visible…………. and you are regarded as “not being disablied since I cannot see anything physically wrong with you”………. Parents, family, Work environment, Local Government, Public, or Private establishment, a bus, a Courtroom, or even if you’ve been arrested and have experienced disregard by the Police or Correctional/Jail, I would just like to read others issues of Discrimination. Please feel free to Vent.

I’m curious to know if anyone has successfully sued any government institution for ADA violations. Federal agencies are exempt from ADA compliance but they are under pre-existing fedreal statute. Fromm all the posts I’ve read it seems that schools are in violation with the spirit of the ADA. Then again what good is a piece of legigislation that is unenforcable and or not enforced? What agency is responsible for enforcing the ADA? Does anyone Know?

I think that agency you’re looking for is the Department of Justice they have a ADA Hotline for filing complaints and how to file complaints a number is1-800-669-4000 you can also look at their website at the following address http://www.usdoj.gov/crt/ada/adahom1.htm

I think also the office of civil rights. At least that’s what I have read for parents making a claim against a school for disregarding a child’s 504 plan which is supposed to be under the auspices of ADA.

I’d be interested to know the DOJs track record on ADA enforcment. Do you think the EEOC would be a place to complain to also?

I am submitting my EEOc Complaint tommorrow. This is not my first time of filing a complaint but my first time directly filing an EEOC complaint in regard to violations of the ADA and a related Employ,ment law in NYS.
