ADD and IEP- Our rights

Submitted by an LD OnLine user on

Hi. I am new here. My husband and I have a
daughter who is 9 years old and in the 3rd
grade. She also has “learning disabilities”,
ADD and has been involved in a IEP since 1st
grade. She is below baseline in Reading and
Math. We just had an IEP meeting this week
and my husband and I are really fed up with
the school. We are tired of the LS teacher,
principal looking down on us. My daughter
does not have Health,Social Studies or Science
because they say there is not enough hours in the day, we tried to change this at the IEP
meeting no such luck. We were told she wouldn’t have any of those classes until middle school, if that makes any sense. IF anybody out there has any advice for us please
respond and help us. We also think that our
daughter maybe Dyslexic she has alot of the
characterics, she needs occupational therapy
but doesn’t qualify according to the school
they didn’t even give us info about getting her tested for this, I had raise questions
to the head of special education to even find
out about getting her re-evaluated which has been 3 years since her last evaluation. We
feel that the schoool is just doing what
the minimal requirement is to help our daughter, which is not much. We also feel that
the Principal is maybe fudging numbers to make her look good as the numbers reflect on the school. Any advice. Thanks in advance!!!

Hi Shawn and welcome here,
You definitely need to get a new evaluation, as a proper diagnosis for most LD’s, can’t be done until a child is 8 years of age.
Where it appears that the one that you had, was done when she was 6.
If you want the school to arrange the evaluation, then you have to personally give them a written request, which needs to be dated.
Also, keep a copy of it for your records.
You might also like to have a look at:

As it looks like you have the typical school situation, where they will only do what you know that you are legally entitled to.
So you need to know all about your rights.

Welcome! I have never heard of student not having social studies, science, etc., because of time constraints until Middle School.

I would contact your District Special Education Supervisor in our district it is the assistant Superintendent. If he is unable to satisfy your concerns, the next step is the Intermediate School District for us in Michigan. Call the desk and they will send you to the right person to help you.

Hope this helps.

Shel
