Can IEP Review be done without current MFE?

We (Intervention Specialists) at our school have been informed that we are to develop review IEP’s without current MFE’s. Is this legal? We were instructed to write the IEP, and wait for the MFE to be completed, and then enter the current MFE information once it is done. We get students who have expired MFE’s (sometimes 1-3 years expired. However, if the IEP is due for review, we were instructed to do the IEP without a current MFE). This concerns us. Is this legal in the state of OH?
