Math for SAT's

I am in a battle with my school over math. My son (ADHD) was put on a track for math freshman year. He is now going to be a senior and will not be offered Algebra II until second semester. This puts him at a HUGE disadvantage for the SAT’s. I feel as if he is not being given equal access to the curriculum in order to reach his potential. Does anyone know if I have legal rights? Do schools have to provide access to the curriculum for SAT’s and such?
