getting testing

My daughter has a nonverbal learning problem, and has a lot of trouble with math (and social skills). We are getting assessment and eval of homework problems at the local university. They asked if the school could test her for placement to determine where the math gaps are. The school declined to test based on “she doesn’t meet the criteria for special ed and she’s doing fine and her grades are ok”. Can they refuse my request for testing? Please respond asap!!

Did you make the request to the school in writing? My understanding is that they have no legal liability with verbal requests, but they are legally required to act upon a parent’s written request.Check out the procedures at the “LD in Depth” section of LDonline. The school can not “determine” that your daughter is not eligible without doing an evaluation and I don’t believe they can refuse your request. Put your request in writing. If you are comfortable with one of her teachers, you might ask them to start the referral process. Once the paperwork has started, they have to follow through.
