Legality of non-certified teacher identified as the EC teach

Can a non-certified teacher with no training in Special Ed legally provide services for these identifed students? I am a gen ed teacher with a sp ed ‘teaching partner’ that fits this description. I was told that I needed to train her and I have no formal training in EC. Am I legally liable if parents figure this out? My identified students’ IEPs state that they are receiving services in the inclusion setting of a regular ed class (indicationg the presence and input of a sp ed teacher.) This is something that has really bothered me. Of course, parents were not informed of a change from a certified sp ed teacher in the classroom, to the present situation. Although I was told that the kids would adapt and not to worry, I have worried because the kids have regressed since the change. They tell me that the new ‘teacher’ mixes them up with her explanations. Just what are the legal ramifications, if any, of this situation?
