If a child is residing w/ the noncustodial parent and IEP meeting is held…..
Mom (me/custodial parent) disagrees w/ the proposed plan and signs as attending and in disagreement….the dad signs that he is okay w/ whatever the school wants to do…
The school implements a new plan….is this okay?
Re: Parents disagree in IEP meeting
You’re good…thanks. I think I just need the confirmation that what I believe is right to do actually is.
Re: Parents disagree in IEP meeting
Sit in the office… having already mailed a registered, receipt-requested letter to the principal and superintendent expressing your concerns about this obvious violation of your parenting rights.
Re: Parents disagree in IEP meeting
In Massachusetts, there are laws that address this issue. I’m sure that is the case in CA also. Call your State Department of Education or access the state law online.
Re: Parents disagree in IEP meeting
If you were notified of the IEP meeting and didn’t attend, that’s one thing, but if they held the meeting without your notification, that’s ridiculous.
I’d do exactly what the others have suggested.
Also, provide notification to the school, the IEP team, the superintendent, and your husband that in the future, no meetings that determine your child’s training program shall take place without you being present.
Keep copies of those documents, too.
I sincerely doubt it is legal, and you should get your lawyer on it if you have one. If not go and sit in the superintendent;s office and make noises about getting a lawyer.
